【重要／有料コンテンツの無断転載について】

現在、とある掲示板において、私がFANBOXで有料・限定公開している画像・動画等のコンテンツが無断転載されていることを確認しています。

本件についてはすでに証拠を保存しており、弁護士へ相談のうえ、対応をすでに進めています。

有料コンテンツを購入したからといって、転載・共有・再配布する権利まで与えられるわけではありません。

著作物の無断転載は著作権侵害にあたり得る行為であり、民事上の責任だけでなく、犯罪として刑事事件・刑事罰の対象となります。

単なる「ネット上のマナー違反」ではありません。

現在、掲示板に私の有料コンテンツを掲載している方は、直ちにご自身で削除してください。

ご自身で削除できない場合は、掲示板運営者へ削除申請を行うなど、掲載を取り下げるための対応を直ちに行ってください。

既に全ての内容を弁護士共有してあり、私自身も削除申請を先生にお願いしています。

私はこれまで誹謗中傷等についても継続して法的対応を行っており、実際に5名について起訴に至っています。

「匿名だから大丈夫」「掲示板なら特定されない」「どうせ何もされない」と考えないでください。

今回の無断転載についても、発信者情報開示請求、損害賠償請求、差止請求等の民事上の措置に加え、警察への相談・刑事告訴を含む刑事上の対応を、弁護士と連携して進めています。

該当する投稿についてはすでに魚拓を含めた証拠を保存しています。

今から削除したとしても、それまでに行われた行為や保存済みの証拠がなくなるわけではありません。

現在掲載している方は、これ以上事態を悪化させることなく、直ちに削除してください。

今後も有料・限定コンテンツの無断転載・再配布・第三者への共有については一切容認せず、確認次第、厳正に対応します

今までFANBOXでは何度も無断転載の被害に遭い、そのたびに悩み、様々な対応を続けてきました。

今までも国内、海外と対応してきました。

時間をかけて対応し、ようやく無断転載がほとんど見られなくなったばかりだったので、今回またこのようなことが起きてしまったことを本当に残念に思っています。

私は真面目に活動しています。

だからこそ、他人の権利を侵害する行為によって活動や、応援してくださっている皆様の気持ちまで踏みにじられることを、もう黙って見過ごすつもりはありません。

誹謗中傷や無断転載などの権利侵害については、今後も厳しく法的対応を続けます。

これまで刑事告訴等の対応を行った案件では、相手方から和解の申し出を受けたことも複数回ありますが、私はすべてお断りしています。

刑事事件についても、私は被害者として厳しい処罰を求める意思・処罰感情を検察官へ明確に伝え、そのうえで検察官に適切な判断をしていただいています。

5名について起訴に至っていますが1名について不起訴となった案件があります。その判断には納得できなかったため、現在、不服申立ての手続きを行っています。

利用できる法的な手続きについて弁護士等と確認しながら、納得できるところまで対応を続けるつもりです。

それ程私にとって誹謗中傷や無断転載は、もう「仕方ない」で済ませたり、許したりすることのできない問題になってます

現在進行中の案件も複数あり、捜査機関による捜査・対応が進んでいるものもあります。

捜査中の案件について、現時点では詳細をお話しすることはできません。

お話できる範囲となりますが、現在進めている法的対応につきましては、

誹謗中傷等について発信者情報開示を行った結果、現在、民事訴訟に至っている案件が4件、刑事告訴を予定している案件が5件あります。

また、刑事告訴については、直近で2件が受理されています。

このほかにも現在発信者情報開示の手続きを進めている案件がありますが、進行中の手続きに関する詳細については、現時点ではお知らせできません。

今後も誹謗中傷や権利侵害、著作権侵害については、弁護士と連携のうえ、必要な法的措置を講じ、引き続き厳正に対応してまいります。

今後、弁護士と相談のうえ、公表して問題のない時期になりましたら、X（Twitter）等で被害に対して行ってきた法的対応や、その結果についてご報告させていただく予定です。

そして今回のFANBOXの件に話を戻します🙏

FANBOXは、料金を支払ってくださった方だけが見ることのできる特別な場所です…🥲

私自身も「お金をいただいている場所」だという責任を持って、本気でコンテンツを作っており投稿しています。

だからこそ、お金を払わなければ見ることのできないコンテンツを勝手に持ち出し、不特定多数が閲覧できる場所へ無断転載する行為を、私は絶対に許すことができません。

何より、きちんと料金を支払い、ルールを守って入会してくださっている皆様の気持ちまで踏みにじられているように感じて、とても辛く、悲しいく心底怒りを感じており、許せないです…

私は無断転載を「ネットだから大したことではない」とは考えておらず著作権侵害や業務妨害として刑事事件になり得る行為であり、それくらい重大なこととして受け止めています。

ルールを守ってFANBOXを楽しんでくださっている皆様には、不安な気持ちにさせてしまって本当に申し訳ありません🙇‍♂️

このような悲しい声明文も見せたくなかったです、本当にごめんなさい。

皆様が安心して楽しめる場所を守れるように、私も更に頑張ります。

これからも「入ってよかった」「応援していてよかった」と思ってもらえるような投稿をたくさん続けていきたいです…！

【IMPORTANT NOTICE / Unauthorized Reposting of Paid Content】

I have confirmed that images, videos, and other content that I publish exclusively for paying members on FANBOX are currently being reposted without my permission on a certain online message board.

I have already preserved evidence of these posts, consulted with my attorney, and legal action is currently underway.

Let me make this absolutely clear: paying for access to my content does NOT give anyone the right to repost, redistribute, share, or otherwise make that content available to third parties.

Unauthorized reproduction and redistribution of copyrighted works may constitute copyright infringement and may result not only in civil liability, but also criminal investigation and criminal penalties.

This is not simply a matter of “bad manners on the internet.”

If you are currently posting or sharing my paid FANBOX content on the message board, remove it immediately.

If you are unable to delete it yourself, you must immediately take the necessary steps to have it removed, including submitting a deletion request to the operators of the message board.

I have continuously taken legal action against online harassment, defamation, and other violations of my rights. As a result of cases I have pursued, five individuals have actually been prosecuted.

Do not assume that you are safe simply because you are anonymous, because you posted on a message board, or because you believe “nothing will happen.”

Regarding the current unauthorized reposting of my paid content, I am working with my attorney and pursuing appropriate legal measures, including requests for disclosure of identifying information, claims for damages, injunctions, as well as criminal measures including consultation with law enforcement and the filing of criminal complaints.

Evidence of the relevant posts has already been preserved.

Even if you delete the content now, that does not erase the actions that have already taken place, nor does it erase the evidence that has already been preserved.

If you are currently posting my content, remove it immediately and do not make the situation worse.

I will not tolerate the unauthorized reposting, redistribution, or sharing of my paid or members-only content. Any further violations that I discover will be dealt with strictly.

I have suffered from unauthorized reposting of my FANBOX content many times in the past, and each time I have struggled with it and taken various measures to address it.

In fact, I have previously taken action against unauthorized reposting both domestically and internationally.

After spending a great deal of time dealing with these issues, unauthorized reposting had finally become extremely rare. That is why I am deeply disappointed that something like this has happened again.

I take my work and my activities seriously.

Because of that, I will no longer silently overlook actions that violate my rights and undermine not only my work, but also the feelings of everyone who supports me.

I will continue to take strong legal action against defamation, harassment, unauthorized reposting, and other infringements of my rights.

In previous cases where I pursued criminal complaints and other legal measures, there have been multiple occasions where the other parties requested a settlement. I have declined all such requests.

In criminal cases, I have also clearly communicated to prosecutors, as the victim, my strong desire for strict punishment. The prosecutors then make the appropriate legal determination based on the case.

There was also one case in which an individual was not prosecuted. I was not satisfied with that decision, and I am currently pursuing the available procedures to have that decision reviewed.

I intend to continue taking every legally available step, in consultation with my attorney and other relevant professionals, until I am satisfied that the matter has been properly addressed.

That is how seriously I take defamation, harassment, and unauthorized reposting.

These are no longer matters that I am willing to simply accept, overlook, or forgive.

There are currently multiple other cases in progress, some of which are being investigated or handled by the relevant law enforcement authorities.

Because these matters are ongoing, I cannot provide specific details at this time.

When the appropriate time comes, and once I have received confirmation from my attorney regarding what information can legally and appropriately be made public, I plan to share updates on X (Twitter) regarding the results of the legal actions I have taken in response to these violations.

Now, returning to the current FANBOX situation 🙏

FANBOX is a special place where content is available only to those who pay for access 🥲

I take very seriously the responsibility that comes with receiving money from my supporters, and I put genuine effort into creating and publishing content specifically for the people who choose to support me there.

That is exactly why I cannot and will not accept someone taking content that is supposed to be accessible only to paying members and reposting it somewhere where an unlimited number of people can view it for free.

More than anything, it hurts me deeply because it feels as though the feelings of everyone who follows the rules, pays for membership, and supports me properly are being disregarded and disrespected 😢

I do not consider unauthorized reposting to be something insignificant simply because “it happened on the internet.”

Such conduct may constitute copyright infringement and, depending on the circumstances, may also raise other legal issues, including interference with business. It can become a criminal matter, and I treat it with the seriousness it deserves.

Regarding this incident, I am not simply going to express my feelings and leave it at that.

I have preserved the evidence, and I will continue working with my attorney to pursue the necessary legal procedures.

To everyone who follows the rules and genuinely enjoys and supports my FANBOX, I am truly sorry if this situation has caused you any concern or anxiety 🙇‍♂️

I will continue doing everything I can to protect FANBOX as a place where everyone can enjoy my content with peace of mind.

I also want to continue creating lots of content that makes you feel, “I’m glad I joined,” and “I’m glad I support her.”
